Every Employer’s Responsibility – New Points Based Immigration Regulations
The requirements, responsibilities and risk of employing any non-EU Nationals
- If you employ non-EU nationals, or are planning to in the future, the chances are that the new
regulations do affect your organisation.
- This week the regulations have been dramatically changed by the Home Office and you are required
to have your Sponsorship Application submitted by November 2008!
- This change is here today & will remain with every organisation indefinitely.
What is involved?
Become compliant / prepare
This requires the organisation to analyse the employment records of all employees to enable the provision of information on the sponsor’s application form.
Apply for a licence
This is an approximately 40 section online application process required to be completed online from your computers within your premises. The questions are complex and require rigorous assessment of records and collation of data before proceeding.
Home Office visit
The Home Office may visit your organisation and perform an audit of your employee records. They have the right to interview any employee in the organisation, not only non-EU nationals. Effectively, your organisation’s human resource function is now responsible for immigration control of your migrant employees.
Remain compliant
If the organisation has handled the above steps in a compliant manner, a Sponsor’s Licence will have been issued. This licence is valid for four years. During this time spot checks may occur and at renewal the Home Office may re-visit your premises.
The new regulations have moved the onus of responsibility paritally to the employer to manage immigration compliance for their migrant workers. The new rules place an onerous responsibility on organisations for remaining compliant to the numerous existing, new and and future Home Offiice regulations.
ComplySoft provides various online solutions to manage these responsibilities. These solutions cover the UK BA requirements in terms of the regulations and will be updated as regulations change in the future.
ComplySoft caters for the detailed information required to be captured for all employees irrespective of their immigration status and then in addition for immigration information required for migrants depending on their permit type. This is information typically not captured in current HR systems or other inhouse systems the employers utilise. A detailed mangement information reporting system provides management with a dashboard view of the employee demographics and potential related risks. For employees and HR departments it provides information relating to renewals and other date related responsibilities.
ComplySoft provides a process flow complaince management solution to guide operational staff in their day to day immigration related duties, tasks and responsibilities. The required control sign offs are provided and the system alerts the user and the management to duties that need to be performed and those that are overdue. The management information provided by this system clearly maps the complaince adherance of staff to the compliance procedures in place. This provides a monitoring and audit function for immigration compliance management.
Evidence libraries are used to store the documents and proof of performance required to be kept and the immigration rules embedded in the system control the maintenance of documents for the required terms.
